Terms and conditions<\/strong><\/h3>\n\n\n\n

V\u00e9g\u00e9tolab inc. hereinafter referred to as ‘Vendor’ and the Purchaser agree that the terms and conditions of sale constitute a contract between the parties upon the signing of an agreement and\/or upon the payment of a deposit corresponding to 30% of the total order.<\/p>\n\n\n\n

The prices indicated on the plant submission form are subject to change without notice. Only a reservation with a deposit paid is not subject to this clause. Prices are EXW plus various charges for packaging (5%), handling, transportation, etc..<\/p>\n\n\n\n

If for any reason Buyer decides not to take delivery of an order during the agreed upon shipping season, Buyer agrees to pay a maintenance and administration fee to Seller who will endeavor to maintain the plants in good condition prior to final delivery. In no event shall Seller be liable for any deterioration of plants that may occur due to Buyer’s choice not to take delivery prior to October 1 of the agreed upon shipping season.<\/p>\n\n\n\n

Our products<\/strong><\/h3>\n\n\n\n

The height of the plants can vary and is given as an indication.  The Seller guarantees that all plants sold are as described in the invoice. An inspection is made at our facilities before the plants leave.  Plants will be in good condition and visibly free of insect pests and plant diseases at the time of shipment. The Seller cannot guarantee the detection of plant diseases, viruses and\/or non-visible defects. We certify that they are visually free of pests and diseases.<\/p>\n\n\n\n

The Seller cannot guarantee the growth and yield of the plants once they have left our facilities due to a large number of factors beyond its control such as: maintenance of the plants before planting, watering, type of soil, drainage of the crop, temperature, fertilization and chemical treatments, soil preparation, etc. .<\/p>\n\n\n\n

Guarantee<\/strong><\/h3>\n\n\n\n

The Seller guarantees that its products are in good condition and properly identified when leaving our facilities as described on the invoice. In case of incorrect identification, the Seller’s responsibility is limited to the value of the plant. The Buyer has 10 days from the day of receipt of the plants to send in writing any complaint regarding the purchased plants. The Buyer is responsible for maintaining the plants purchased in good growing condition during this period. V\u00e9g\u00e9tolab inc. will replace or reimburse, at its convenience, the non-conforming plants.  The responsibility of V\u00e9g\u00e9tolab inc. shall in no case exceed the value of the plants purchased\/delivered. After this period, the Buyer accepts the product as is.<\/p>\n\n\n\n

Delivery<\/strong><\/h3>\n\n\n\n

The organization of the delivery is under the responsibility of the Buyer. To accommodate the customer, V\u00e9g\u00e9tolab inc. can take care of the transportation at the request of the Buyer and at the expense of the customer.  The customer will then benefit from the discount\/transportation that V\u00e9g\u00e9tolab inc. has negotiated with the carrier.<\/p>\n\n\n\n

V\u00e9g\u00e9tolab inc. cannot be held responsible for the condition of the plants when they arrive at the customer’s home. Please notify the carrier of any damage to the merchandise.<\/strong><\/p>\n\n\n\n

Reservation of plants<\/strong><\/h3>\n\n\n\n

The minimum order is $1 000.00 before taxes and royalties and a minimum of one tray per cultivar.<\/p>\n\n\n\n

A 30% deposit is required to establish the reservation of plants and is non-refundable in case of cancellation by the customer.  In case of cancellation after February 28, a fee may be charged to the buyer.<\/p>\n\n\n\n

You may pay your 30% deposit and final payment by Access D, credit card or check.<\/p>\n\n\n\n

Terms of payment<\/strong><\/h3>\n\n\n\n

Final payment of the invoice must be made 1 month before delivery.<\/p>\n\n\n\n

Commitment not to multiply the plants<\/strong><\/h3>\n\n\n\n

The plants sold under license are strictly forbidden to be multiplied regardless of the methods used and the future use (personal or resale). Sanctions may be applied to any offender.  The buyer is bound by this condition from the moment of the signature of a purchase contract or the payment of an amount for the reservation of the plants.<\/p>\n\n\n\n

The buyer agrees to receive an inspector on behalf of the hybridizer or his representative at any time and without notice for inspection purposes.<\/p>\n\n\n\n

Application of laws<\/strong><\/h3>\n\n\n\n

In the event of any dispute concerning this sale, the laws and regulations of Quebec are applicable and the dispute must be settled on the territory of Quebec.<\/p>\n\n\n\n
